1. Acceptance of Terms

By accessing or using Trust Push ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Trust Push. If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Trust Push is a web push notification delivery service that allows website owners, bloggers, and businesses to send push notifications to users who have opted in to receive them. Our Service includes:

  • Web push notification delivery to opted-in subscribers
  • Account-based management of websites and notification campaigns
  • Dashboard for managing subscribers and sending notifications
  • Usage limits based on your subscription plan (send limits, number of sites, rate limits, etc.)

All limits are account-level and shared across all sites within your plan. If one site uses a portion of your limit, the remaining capacity is available for your other sites.

3. Account Registration

To use Trust Push, you must create an account. When registering, you agree to:

  • Eligibility: You must be at least 18 years old and capable of forming a binding contract. If you are registering on behalf of a business, you represent that you have the authority to bind that entity to these Terms.
  • Accurate Information: Provide accurate, current, and complete information during registration and keep your account information updated.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Authentication & Access

Trust Push offers multiple authentication methods for your convenience:

  • OAuth Providers: Sign in using your Google or X (formerly Twitter) account.
  • Email-Based Login: Register and sign in using your email address and password.

By using third-party authentication providers, you also agree to their respective terms of service and privacy policies.

5. Subscription Plans & Billing

Trust Push offers paid subscription plans. There is no free plan, although you may register an account without an active subscription:

  • Lite Plan: $9/month – Unlimited subscribers, 50 sends/month, 1 website, and more.
  • Pro Plan: $89/month – Unlimited subscribers, unlimited sends, 5 websites, and more.
  • Business Plan: $299/month – Unlimited subscribers, unlimited sends, 20 sites, and more.

Billing is processed through Dodo Payments, our merchant of record. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, but you will retain access until the end of your current billing period.

6. Refund Policy & Free Trial

Trust Push offers a 14-day free trial on all subscription plans to help you evaluate our service.

  • Free Trial: You get access to the trial features for 14 days without any charge after creating an account. To avoid spam, the following limits apply during the free trial period:
    • 1,000 Subscribers
    • 30 Sends maximum
    • 1 Website
    • 1 Team Member
    • Chat Support only
    You can lift these free trial limits immediately by subscribing to a paid plan.
  • No Refunds: Since a free trial is provided, we do not offer refunds once a paid subscription begins. Payments are non-refundable.
  • Cancellation: You can cancel your subscription at any time. If you cancel, you will continue to have access to the Service through the end of your current billing period.

7. Acceptable Use Policy

You agree to use Trust Push only for lawful purposes and in accordance with these Terms. You may not:

  • Send Spam: Send unsolicited or bulk notifications to users who have not opted in.
  • Distribute Illegal Content: Use the Service to distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Send Deceptive Notifications: Send notifications that are misleading, fraudulent, or designed to deceive recipients.
  • Violate Others' Rights: Use the Service in a way that infringes upon the intellectual property, privacy, or other rights of third parties.
  • Compromise Security: Attempt to gain unauthorized access to the Service or its related systems.
  • Abuse the Service: Use automated means to access the Service in a manner that exceeds reasonable use or places undue burden on our infrastructure.

8. Business Use & Client Management

If you are a business or agency managing notifications on behalf of clients:

  • Client Websites: You are permitted to manage push notifications for your clients' websites using your Trust Push account.
  • Verification: You must verify ownership or authorization for each client website you add to your account.
  • Recommended Plan: The Business Plan is designed for this use case and allows managing multiple sites under one account.

9. Push Subscriber Responsibility

As a Trust Push user, you are responsible for ensuring that:

  • Lawful Consent: All push notification subscribers on your websites have explicitly opted in to receive notifications and have provided lawful consent.
  • GDPR Compliance: You acknowledge that you are the data controller for your subscribers' data and agree to comply with all applicable GDPR regulations regarding data collection, processing, and user rights.
  • Browser Policies: Your use of push notifications complies with the policies of major web browsers (Chrome, Firefox, Safari, Edge, etc.).
  • Unsubscribe Options: You provide clear instructions for users to unsubscribe from notifications.

10. Service Availability

While we strive to provide reliable service, Trust Push is provided on an "as available" basis:

  • No Uptime Guarantee: We do not guarantee any specific level of uptime or availability.
  • Maintenance Windows: We may perform scheduled or unscheduled maintenance that temporarily affects service availability. We will make reasonable efforts to notify you of planned maintenance in advance.
  • Third-Party Dependencies: Service availability depends on third-party infrastructure, including Firebase and browser push notification systems.

11. Account Suspension & Termination

We reserve the right to suspend or terminate your account at our discretion for the following reasons:

  • Abuse: Violation of the Acceptable Use Policy, including sending spam or illegal content.
  • Non-Payment: Failure to pay subscription fees when due.
  • Policy Violations: Any breach of these Terms or our Privacy Policy.

Upon termination, your right to use the Service will immediately cease. We may delete your account data after a reasonable period following termination.

12. Intellectual Property

Ownership of Trust Push: The Service, including its design, features, content, trademarks, and all related intellectual property, is owned by Trust Push. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

User Content Ownership: You retain ownership of all content you create and send through the Service, including notification messages and images. By using the Service, you grant us a limited license to process and deliver your content as necessary to provide the Service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • No Indirect Damages: Trust Push shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
  • Service Provided "As-Is": The Service is provided on an "as-is" and "as available" basis without warranties of any kind, either express or implied.
  • Liability Cap: In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Trust Push and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party, including push notification subscribers
  • Any content you send through the Service

15. Modifications to Service or Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We may also update these Terms from time to time. Material changes will be communicated via email or through a notice on our website.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
